Terms and Conditions applicable to mail order and web related sales

 In accordance with the consumer protection (Distance Selling) Regulations 2000 and the Data Protection Act 1998.

When buying goods on the Internet or mail-order you are entering into a legally binding contract, the terms of which are detailed below.  Any variations to the agreed terms are only applicable if details are provided on an individual contract.

Definitions

Buyer           the person who buys or agrees to buy the Goods from the Seller.

Seller           means Leisure Heating Ltd

Conditions     the terms and conditions of sale as set out in the document and any special terms and conditions agreed in writing by the seller.

Goods           the articles which Buyer agrees to buy from the Seller.

Conditions

These Conditions shall form the basis of the contract between Seller and Buyer in relation to the sale of Goods, to the exclusion of all other terms and conditions including the Buyer’s standard conditions of purchase or any other conditions, which the buyer may purport to apply under any purchase order or confirmation of order or any other document.  These terms and conditions should be read in conjunction with the seller’s general terms and conditions.

 All orders for goods shall be deemed to be conclusive evidence of the buyer’s acceptance of these Conditions.

 These Conditions may not be varied except by the written agreement of a representative of the seller.

 These conditions supersede any other conditions previously issued.

 Payment

All Goods must be paid for in full at the time of ordering unless terms have varied by prior arrangement. Payment is in GBP pound sterling by most acceptable methods including credit card, cash, and cheque. VAT is applicable at United Kingdom rates. Businesses within the European Union that can supply a valid VAT number are responsible for payment of VAT or equivalent taxation at their own country rates. Businesses outside of the realms of the EU shall be responsible for both import tariffs and taxation.

We reserve the right to make an extra charge for delivery of goods outside mainland England and Wales, the Scottish Highlands and Cornwall or for accompanying products, which compliment a full order.

Interest on overdue invoices shall accrue from the date when payment becomes due calculated on a daily basis until the date of payment at the rate of 8% per annum above the Bank of England base rate from the time to the time in force. Such interest shall accrue after as well as before any judgement. We will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if you do not pay us in accordance with our agreed terms.

All Goods remain the property of the seller until payment is received in full. The risk in all goods supplied by us shall pass to the Buyer at the time of delivery, notwithstanding that the goods remain the property of the seller until paid in full.

Credit Accounts

We will consider an application to open a credit account on receipt of satisfactory bank and two trade references.

If You Change Your Mind

You may cancel your order for any reason up to the end of the 7th working day after you place your order.  If you do, the following terms will apply:

To cancel your order you must notify the seller in writing by post

If you cancel your order but the seller has already dispatched the Goods, you must call us to arrange a return, which will be at your cost and risk.

All goods must be returned in their original packaging and will be examined by the seller before a refund is considered.  The Seller reserves the right to charge for damage caused to unwanted Goods.

Delivery

We will endeavour to deliver within a 30-day period, although lead times will vary according to season and destination. If we cannot deliver the goods within this time, we will inform you and agree on another time for delivery. If we cannot agree on another time, we will offer a full refund.

Where delivery dates are given, they are without liability and time is not the essence of contract.

 

Damage/Shortage

All Goods delivered must be examined for damage and/or shortage and any damage or shortage must be reported to the seller in writing within 7 working days or receipt at the Buyer’s premises.

 

Complaints

Complaints will be acknowledged with 72 hours and dealt with according to each manufacturers own guidelines in a fair and confidential manner. The Buyer will be kept fully informed during the process of resolving the issue by phone and/or email. If replacement goods are required in order to rectify any fault or deficiency, this should take no longer than 14 working days.

 

Cancellations

Should for any reason you wish to cancel your order (including faulty goods, or goods failing to meet the description) this must be done so in writing no later than 7 days after receiving the goods or within seven working days from order. The buyer maybe responsible for the costs of returning goods unless your reasons are validated by this office. Before goods are returned, the cost must be validated by the seller.

 

Mistakes in bills, receipts or payments

Any mistakes in bills, receipts or payments will rectified as soon as possible, and at latest within 30 days of agreeing to do so.

 

Refunds

When the situation arises a refund will be made as soon as possible and at the latest, within 30 days of agreeing to give the refund.

 

Data Protection

The seller is committed to protecting your privacy.  We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).  The seller does not supply your personal information to others.

The type of information we will collect about you includes: Your name, address, Phone number, email address, credit/debit card details and marketing details.  Our marketing department is responsible for the upkeep of this information and can be emailed directly on enquiries@leisureheating.co.uk  The information we hold will be accurate and up to date.  You can check the information that we hold about you by emailing us.

We will never collect sensitive information about you without your explicit consent. If you find any inaccuracies we will delete or correct them promptly.  We will give you the chance to refuse any marketing email from us in the future.

Trademark Notice

All trade names, trademarks, logos and titles used on our website and associated marketing literature are trade names and trademarks of their respective holder.

Force Majeure

The seller will not be liable to you in the event that it is prevented by circumstances beyond its control from delivering Goods that you have ordered or for any damaged or defective Goods.

Breach of these terms

In the event of the Buyer being in breach of any of these conditions, The seller shall be entitled to refuse to supply the buyer with any further goods, or suspend delivery until all breaches have been remedied.

None of the above affects your statutory consumer rights.

English Law shall govern these terms and conditions.
